Whereabouts do you live?

A

Nunica.

How long have you lived there?

A

About two years.

Where did you live prior to that time?

A

Up in Ravenna Township

Are you acquainted with Bill Shimmel or William Shimmel as he is called?

A

Yes, sir.

The respondent there?

A

Yes, sir.

How long have you known him?

A

Why about twelve or fourteen years.

Which direction from Nunica do you live?

A

Northeast, up in Ravenna Township.

A

Whether or not your land joins the D. & M. Railroad right of way and whether the interurban, as we call it, right of way, passes through your land?

A

Yes, sir, the interurban passes it and it joins the Grand Trunk on the south side also.

Where you at home on the 23rd day of April 1906?

A

Yes, sir.

Do you remember of the fact of Martin Golden having been killed that night of the 23rd?

A

Yes, sir.

You remember of the fact?

A

Yes, sir.

Now that afternoon before Martin was killed where were you working?

A

Just across the interurban in a little piece of ground, dragging in oats.

That would be between the interurban and the D. & M?

A

Yes, sir.

And what time in the afternoon were you dragging there?

A

Why I worked there all the afternoon.

Now between four and five o’clock did you see anybody going east on the D & M track?

A

Yes, sir.

About how far from Nunica was that person when you saw him going east on the D & M track?

A

Why nearly a quarter of a mile or so.

How was the party dressed if you remember?

A

Why he wore a kind of a brownish looking overcoat or something

similar to it, a kind of a short coat, and a slouchy looking hat.

A

Yes, sir.

And at that time did you think you knew that party?

A

Why after he was gone by, as near as I could place him, it come to my mind that I thought it was Bill Shimmel that I used to know.

And whether or not in your judgment it was Bill Shimmel that you saw going by there that afternoon on the railroad?

A

I am not for certain whether it really was him or not but that was my idea.
